Foreclosure, in ordinary home-loan language, means paying off the entire loan before the last EMI. The account closes. A part-payment is the smaller cousin: you pay a lump sum and the loan continues, with a lower EMI or a shorter tenure. Lenders and the Reserve Bank also say “pre-payment” for both.

Prepay Home Loan vs. Invest
Should you pay off your home loan early, or put the extra money into mutual funds?
Open calculatorThe charge, where one exists, is what the circulars argue about. On 5 June 2012, RBI/2011-12/589 told banks not to levy foreclosure or prepayment penalties on floating-rate home loans. On 7 May 2014, RBI/2013-14/582 extended that to all floating-rate term loans to individual borrowers. On 2 August 2019, RBI/2019-20/29 stated it for floating-rate term loans to individuals for purposes other than business, with or without a co-obligant.
The Reserve Bank of India (Pre-payment Charges on Loans) Directions, 2025, number RBI/2025-26/64, were issued on 2 July 2025 and apply to loans sanctioned or renewed on or after 1 January 2026. For a floating-rate loan to an individual for a non-business purpose, the lender shall not levy a prepayment charge. That covers part and full payment, any source of funds, and it sets no lock-in. The earlier circulars are repealed from that date and stay relevant for loans from the years they covered.
A fixed-rate loan is outside that ban. So is a case the Directions do not list. The charge then follows the lender’s approved policy, and on a term loan it is based on the amount prepaid. It has to be in the sanction letter and the agreement. Where a Key Facts Statement is required, it has to be there too. An undisclosed charge cannot be added on the day you close. If the lender itself asks you to close, it cannot levy the charge.
A loan that is fixed for some years and floating for others follows the rate on the day you foreclose. Floating that day means the ban applies. The prepayment guide compares a part-payment that cuts the EMI with one that cuts the tenure. Foreclosure is the same maths taken to a zero balance.
Interest does not stop on the day you decide to close. It runs until the day the lender receives the money. Ask for a foreclosure quote that names that day, and pay it by then. A quote from last week can be short by a few days of interest, and the account will stay open until the shortfall is paid.
Checked on 3 November 2026. Get the closure figure in writing, including any interest up to the day you pay, before you transfer the money.
Questions
Is foreclosure the same as a part-payment?
No. A part-payment leaves a balance and a remaining schedule. Foreclosure pays off the whole loan. The floating-rate ban on charges covers both, for an individual borrowing for a purpose other than business.
Which loans can still have a foreclosure charge?
A fixed-rate loan can, if the charge was disclosed in the sanction letter and the agreement. Loans sanctioned before 1 January 2026 follow the circular that was in force then. The June 2012 circular already stopped banks charging a penalty on floating-rate home loans.
What should I collect when I close the loan?
A closure letter, the updated interest certificate, and a statement that the balance is zero. If the property papers were with the lender, ask for the release. The old-regime principal deduction for that year still stops at the section 123 cap.
